The objective of the study was to identify Appeal, Non-Suspensive Effect, and Stay of Execution in UAE Law: A Comparative Study. The study reached many important findings, including that no legal texts define the suspension of execution of an administrative decision, whether in the Egyptian, French or Emirati State Council law. Therefore, its determination was left to the jurisprudence and the judiciary. The Egyptian and Emirati legislators granted the judge the discretionary authority to suspend the implementation of the administrative decision, without obligating him to take the decision to suspend it. The UAE administrative judiciary added a seriousness requirement to accept requests to suspend the implementation of the administrative decision, although the legislator did not impose this obligation, which constitutes an obstacle to the settlement of these requests. The French legislator innovated the inclusion of the suspension of execution system within the competencies of the judge of urgent administrative matters, under the new codification that entered into force on the 1st of January 2001, where a distinction was made between the annulment lawsuit and the application for suspension of execution, making the annulment judge different from the execution judge, an advanced legislative development that reflects the French legislator's realization of the importance of expediting the decision on applications for suspension of execution in order to achieve immediate justice.

هدفت الدراسة إلى التعرف على الطعن القضائي: الاستئناف والأثر غير الإيقافي ووقف التنفيذ في القانون الإماراتي: دراسة مقارنة، وقد اعتمد الباحث في دراسته على المنهج الوصفي التحليلي والمنهج المقارن، وتوصلت الدراسة إلى العديد من النتائج من أهمها: أنه لا توجد نصوص قانونية تحدد تعريفًا لوقف تنفيذ القرار الإداري، سواء في قانون مجلس الدولة المصري أو الفرنسي أو الإماراتي، إذ تُرك تحديده للفقه والقضاء، وقد منح المشرع المصري والإماراتي للقاضي السلطة التقديرية في مسألة وقف تنفيذ القرار الإداري، دون إلزامه باتخاذ قرار الوقف، حيث أضاف القضاء الإداري الإماراتي شرط الجدية لقبول طلبات وقف تنفيذ القرار الإداري، على الرغم من أن المشرع لم يفرض هذا الشرط، مما يشكل عقبة في سبيل حسم هذه الطلبات، وابتكر المشرع الفرنسي إدراج نظام وقف التنفيذ ضمن اختصاصات قاضي الأمور الإدارية المستعجلة، بموجب التقنين الجديد الذي دخل حيز التنفيذ في الأول من يناير 2001، حيث تم التفريق بين دعوى الإلغاء وطلب وقف التنفيذ، مما جعل قاضي الإلغاء مختلفًا عن قاضي التنفيذ، وهو تطور تشريعي متقدم يعكس إدراك المشرع الفرنسي لأهمية تسريع البت في طلبات وقف التنفيذ من أجل تحقيق العدالة الفورية.
